Hereinafter referred to as “the Service Provider”

 

Article 1 - SERVICES

 

The Service Provider agrees to perform the services indicated on the quote/invoice with the specified options.

 

Article 2 - PRICE AND PAYMENT TERMS

 

The final price indicated on the quote/invoice corresponds to the total amount of the services, including the options selected by the client.

 

To confirm the booking, the quote must be signed and a 30% deposit is required. to be paid by bank transfer.

 

The total amount for the service must be paid before the start of the service (no later than the day of the event, upon the service provider's arrival).

 

Mileage fees are included in the price. Exceptions may apply for events located more than 200 km from Avesnes-sur-Helpe; in this case, it will be specified in the quote and discussed with the client beforehand.

 

Article 3 - OBLIGATIONS

 

The client agrees to provide the necessary space for the installation of the sound and lighting equipment, and sufficient electrical power near the equipment (220V, 16/20 amp outlets).

 

The client agrees to provide at least one table for the sound system setup.

 

The client agrees to allow the service provider access 3 hours in advance for equipment setup and adjustments, as well as a parking space near the event.

 

The client is responsible for all... Equipment, sound system, lighting, records, and computers will be stored on the premises provided, and the mobile DJ will take all necessary security measures from arrival to departure.

 

The client must provide the DJ with a full hot meal and non-alcoholic beverages during the event.

 

The number of hours of service is indicated on the quote. Beyond this, each additional hour of entertainment started will be billed at €75.

 

These hours are for the actual entertainment time; setup and teardown time are included in the price and are not considered overtime.

 

For outdoor events, the DJ and their equipment will not be exposed to inclement weather (cold, heat, rain, snow, hail, or other) without adequate protection (covered stage, gazebos, marquee, parasol, or other means of protection).

 

Article 4 - RESPONSIBILITIES

 

The client is responsible for the event. They are responsible for all declarations and applications for administrative permits. in a timely manner.

 

The client assumes full responsibility for the behavior and actions of their guests.

 

In the event of damage to the equipment by a third party, the repair costs will be borne by that party; the same applies to rental costs incurred until the repaired equipment is received, in order to avoid jeopardizing future commitments. If the equipment is irreparable, the party responsible for the damage will be billed at the price of a similar new item, according to current rates.

 

The service provider's liability can only be invoked in the event of a failure to fulfill its obligation of due diligence.

 

Furthermore, the client may not invoke this liability in the following cases:

 

If they have failed to provide the service provider with a document or information necessary for the assignment;

 

In the event of force majeure or other causes beyond the service provider's control;

 

In the event of equipment malfunction.

 

The service provider cannot be held liable for the non-functioning or malfunctioning of its installed equipment due to a defective electrical installation or insufficient power at the site. Reception.

 

Article 5 - SERVICE VALIDATION

 

The service will be definitively validated once the quote is signed and the 30% deposit is paid.

 

Article 6 - CANCELLATION/MODIFICATION OF CONTRACT

 

After signing, the client has a 14-day legal right of withdrawal.

 

Once the service has been validated, if the scheduled event cannot take place, the defaulting party, without prejudice to any other damages, will only be entitled to the provisions related to the deposit mentioned below.

 

Deposit - Article 1590 of the Civil Code:

 

“If the promise […] has been made with a deposit, each of the contracting parties is free to withdraw from it, the one who gave it, by forfeiting it, and the one who received it, by returning double the amount.”

 

Information:

 

- In case of cancellation by the client, the deposit is not refunded.

 

- In case of cancellation by the client, less than 3 One month before the date of the service, full payment is due (a credit note may be issued depending on the reason for cancellation (death, hospitalization) upon presentation of legal documentation)

– In case of modification/revised service

The price reduction (see example below) by the client after signing the quote and paying the deposit: The balance of the base contract amount is due (the difference will be refunded to the client as a credit note). → Example: You book a service for €1000, you pay a €300 deposit → A few months later, you want to reduce the price of the service (options removed or a lower-priced service) → Example: a service for €500

→ This service is less expensive than the base service, but you will still have to pay the remaining €700 of the base service.

 

→ In total, you will have paid €1000 (base contract service) for a service worth €500 (new service) → You will therefore have a €500 credit note to be used for a future service (according to the conditions mentioned on the credit note).

 

In the event of force majeure preventing the service provider from fulfilling the contract, they agree to provide a replacement Entertainer/DJ, without any change in rates, subject to the availability of this Entertainer/DJ.

 

Article 7 - TERMINATION OF CONTRACT

 

• In the event that the service provider is subjected to mistreatment, insults, or abnormal behavior by the client, their representatives, or guests.

 

• In the event of intentional damage to or theft of equipment provided by the service provider.

 

• In circumstances where the physical and/or moral well-being of the service provider is endangered.

 

• In circumstances where the integrity of the equipment is endangered.

 

• In the event that the client fails to comply with the terms of this contract.

 

If any of these circumstances occur, the service provider may leave the premises. of the service without any possibility of a refund, and the client will remain liable for any sums owed.

 

In the event of a dispute, both parties will submit to the jurisdiction of the courts of Valenciennes (Nord, 59).

 

Article 8 – SACEM (French Society of Authors, Composers and Music Publishers)

 

SACEM fees are the responsibility of the client organizing the event. The service provider can provide the client with a list of the songs played during the performance upon request.

 

In the case of a private family event (wedding, christening, birthday, etc.), the service is exempt from SACEM fees.

Article 9 – MISCELLANEOUS PROVISIONS

 

• The service provider does not open or close the reception venue.

 

• Games and musical selections, even those specified in the program, may be removed by the entertainer (with the client's agreement) to ensure the success of the event.

 

• Dismantling time is approximately 1 hour 30 minutes.

 

• During the event, the service provider is authorized to take photos and videos and use them for promotional purposes. You have the right to request corrections.

The terms and conditions that apply to your event are those in effect at the time of your signature.

If a change to the terms and conditions is expected to impact your event, the service provider will inform you and your mutual agreement will be requested.
